small claims suit/employer/employee rights??

Husband being sued in small claims court by past employer for a cell phone that was stolen from company van or elsewhere. He says he turned the phone into the office and he did not make the calls. He is being made responsiable for the charges of $771.00. Can you advise us? He has no proof either to counter claim this.
